Taishan Insurance Brokers Philippines, Inc. (the “company”) is committed to maintaining and protecting the privacy of the data that we obtained in the course of its business. We acknowledge that the data, personal information and sensitive personal information (collectively referred to as personal data), we collect and process are handled by incorporating the standards defined by the  Republic Act No. 10173 (“Data Privacy Act of 2012” or “DPA”), our Internal Data Privacy Policies and other laws allowing disclosure of information to the public and adherence to the principles of transparency and legitimate purpose.

This Privacy Notice is to help you understand that the Personal Data we collect, why we collect it, and what we do with it.

What We Collect

When you engage a service to us, we arrange and manage your insurance program or policy, and assist in insurance claims on your behalf, we will be asking you for your Personal Data (Personal and Sensitive Information), including but not limited to:

• Name/s of Insured and Beneficiaries. This includes demographic information (birthdate, gender, age, nationality) and other relevant information.
• Medical Records. This includes diagnosis, prescriptions, medical certificates, medical abstract, laboratory results, results of annual physical exam (if applicable), confinement details and/or medical consultation details.
• Government Issued Identifications (Passports, UMID, Drivers License, etc.)
• Company Profiles and Details
• Financial Details (Bank Account Information, etc.)
• Transaction History. This includes your communication with us but not limited to providers and other entities with regards to your insurance. Data Captured by our Surveillance (CCTV) System is also included.
• Other information that is required to be collected by the Insurance Commission and the Anti-Money Laundering Council (AMLC) issuances.

If you have provided a Personal Information to the company regarding other individual, you agree:

• To inform the individual about the content of this Privacy Policy; and
• To obtain any legally required consent for the collection, use, disclosure and transfer of Personal Data (Personal and Sensitive Information) about the individual in accordance with this Privacy Policy.

Why we collect them

We collect, hold, process, use and disclose your Personal Data (Personal and Sensitive Information) in the following manner and for the following purposes:

• To respond to your inquiries and request, improve our services and resolve your concerns;
• To establish and maintain our communication with you;
• To confirm you are our client and to verify your identity, and to validate your identity, and to validate your coverage.
• To arrange insurance coverage in accordance with your requirements with insurers and providers;
• To manage your insurance coverage, including placement, renewal, invoicing, and providers,
• To properly administer the services, benefits, and fulfill our obligations under our service contract;
• To assist, manage, and process your claims, including healthcare insurance claims, where we may obtain, examine, and process medical records, as well as request for these on your behalf, in order to facilitate settlement of your claims;
• To provide you with relevant information, updates and announcements regarding our services;
• To comply with legal obligations or comply with law enforcement;
• To prevent a threat to life or health; or
• To perform other activities you have consented to.

The information that you share with us during any of these processes, whether online or any other means, will be handled with due care and confidentiality and in adherence to our information security policies. These also enable us to perform our business in a sound manner in the prevention of fraud and to ensure the protection of our stakeholders.

Who Collects your Data and How to Contact them

Your data shall be collected through various means including hardcopies of forms and the like, email, telephone, or through correspondence with your company authorized representatives whom you have entrusted your data with, and only by authorized employees who shall be also responsible with its secured processing.

Collection may be done by our Liaison Officers, Account Support and Account Managers. No collection shall be done without your prior consent or without legal basis. No data shall be collected that is in excess of the specified purpose.

With Whom Will We Share the Data

We share your data for legitimate purposes, in compliance with our contractual and regulatory obligations, or on a need to know basis. We only transfer data that is necessary to fulfill the purpose/s and ensure to transfer data in a secure manner. We shall not disclose any such information unless authorized by our clients as required by law.

Taishan Insurance Brokers Philippines, Inc. may share the information to the following:

• Legal Counsel, Auditors and Service Providers who engage with for support services or in fulfillment of our obligations;
• Insurers and their Underwriters to assess the insurability, premium, coverage and terms;
• Health Care Providers and Medical Professional; and
• Adjusters;

In cases not required by law, such arrangements are covered by the appropriate Data Sharing Agreements and/or Non-Disclosure Agreements to ensure the same level of protection is observed.

How we Protect your Information

Taishan Insurance Brokers Philippines, Inc. shall maintain your Personal Data (Personal and Sensitive Information) in confidence using such reasonable and appropriate Physical, Technical and Organizational measures to protect and safeguard the Personal data that you have entrusted to us in accordance with the Data Privacy Act.

Storage and Retention and Disposal of Personal Data

Taishan Insurance Brokers Philippines, Inc. takes reasonable steps reasonable steps to collect and use accurate and complete Personal Data as needed to carry out the purposes describe in this Privacy Policy. The company stores data electronically (On-premise) or in paper form.

Taishan Insurance Brokers Philippines, Inc. will only retain Personal Data for the period necessary to fulfill the purpose outlines in this Privacy Policy unless a longer retention period is required or permitted by law.

The precise period will depend on the purpose for which we hold your information.  In addition, there may be laws and regulations that apply to us which set minimum periods for retention of Personal Data.

Electronic files stored on storage media devices are securely disposed by wiping and erasing the device and, thereafter, shredding the device. Physical files are disposed of by secure shredding.

Your Rights as the Data Subject

• The right to be fully informed, to access your Personal Information, and to request a copy of the Personal Data we have on file.
• The right to request for your Personal Data to be rectified or updated, to ensure that your Personal Data on file is reliable, accurate, complete, and as current as possible. We will be happy to assist you with this, subject to receipt of a written request or a request made through email communication.
• The Right to suspend, withdraw or order the blocking, removal or destruction of his or her personal information upon grounds provided by the law, without prejudice to the company continuing to process personal data for commercial, operational, legal and regulatory purposes.
• The right to report any misuse of your Personal Information. With rights, however, come responsibilities including, for example, the expectation that you will provide complete and accurate information to us, as your insurance provider.
• The Right to be indemnified for any damages sustained due to such inaccurate, incomplete, outdated, false, unlawfully obtained or unauthorized use of personal information.

Data Breach Notification

In the event that Taishan Insurance Brokers Philippines, Inc. and/or its Representatives are legally compelled to disclose any Confidential Information of the Client, the company shall promptly give notice to the Client so that the latter may obtain the appropriate protective order and/or remedy under the law. However, in the event the Client fails to obtain any legal remedy, the company shall disclose the information required by the court and/or competent authorities, without incurring any liability to the Client.

Updating your Information

As much as possible, we would like to collect and process your most up to date information. This will also avoid any forms of misrepresentation while we fulfill our insurance brokering and risk management services. Changes and Updates to This Privacy Policy

Our Privacy Policy may change from time to time to comply with applicable laws and regulations and to reflect changes to our information practices. We will post updates in our website, and if the changes are significant, we will provide a more prominent notice (such as an e-mail notification of privacy policy changes). We will also keep prior versions of this Privacy Policy in an archive for your review.
